December 2024 Update
In accordance with the Development Procedures Bylaw, notice of consideration of the proposed Environmental Development Permit and Foreshore Development Permit for 1768 & 1770 Argyle Avenue was given to owners and occupants of all parcels of land within 50 m of the subject site.
The majority of the concerns received through the public notification process were related to the programming and operations of the site, access, public safety, parking and traffic and were outside of the scope of the development permit review. Programming and operations of the site (e.g. use, building size, hours of operation, noise etc.) were determined by the lease agreement.
Following the review of the comments received and consideration of the proposal against the relevant development permit area guidelines, the Director of Planning, Development and Environment Services approved Development Permit 24-025 on December 19, 2024.

An application for an Environmental Development Permit and Foreshore Development Permit with variances has been submitted to allow for renovation, restoration, and expansion of the significant heritage building known as the “Navvy Jack House” on the subject site, which consists of two legal lots.
Lawson Creek travels along the eastern property line of the subject site. An Environmental Development Permit is required due to the proposed works within the 15-metre setback from the top of the watercourse bank. Further, a Foreshore Development Permit is required for alteration to the existing building within 15 m of the natural boundary of the ocean.
Under the Environmental Development Permit and Foreshore Development Permit, zoning variances may be considered by the Director of Planning and Development Services to prevent or reduce loss of habitat within 15 metres of the top of the watercourse bank and to protect the building from coastal flooding hazards. Zoning bylaw variances to the south yard setback and to allow the building to straddle the property line between the two lots are requested, as per proposed plans, to allow for the proposal.

Council has delegated the approval of watercourse protection and foreshore protection development permits to the Director of Planning & Development Services, subject to public input. Please provide your written comments no later than 4:30 p.m. on Monday, December 16, 2024, to make them available to the Director for his consideration.
