On Monday, October 28, Mayor and Council adopted the road closure bylaw that closes the road allowance (the “Road Parcel”) adjacent to 3000 Park Lane (the “Property”) that allows the District to proceed with the disposition of both sites. If the Property and Road Parcel is sold to the current prospective Buyers, the District will receive a statutory right of way in perpetuity to allow for the installation of a public trail on the east side of the Property, to replace the existing trail that requires significant repairs. If the Road Parcel was not part of the disposition proposal and only the Property was sold, the existing trail would still need to be rebuilt by the District within the Road Parcel, as the existing trail is misaligned and runs through the Property.
Due to the economies of design, engineering, and construction integration, the prospective Buyers will design the trail based on District standards and construct the trail from Park Lane to the drop off point, at no cost to the District. The District will be responsible for the construction of the trail from the drop off to the foreshore property line. Given the potential unknown geotechnical conditions on the foreshore, the installation could be complex and expensive, however, the majority of the trail will be paid for by the prospective Buyers. The removal of the existing path will be completed by the prospective Buyers at no cost to the District.
The prospective Buyers will provide the District a Licence to Occupy to allow the public to use the existing trail until such time it is unsafe to do so due to temporary construction. The prospective Buyers in conjunction with the District will construct the new trail on the east side of the site as soon as reasonably possible and, if it is safe to do so, make best efforts to have the new trail in place prior to the completion of the proposed dwelling.
